End User License Agreement

Which terms apply

DRAKE OS is sold through AWS Marketplace. The license terms for your subscription are the end user license agreement attached to the AWS Marketplace offer you accept. Unless your offer states otherwise, that is the Standard Contract for AWS Marketplace (SCMP).

If you receive a private offer, it may include an amended or custom agreement negotiated with you. In that case the terms attached to your private offer control. You can view the agreement for any subscription in the AWS Marketplace console under Manage subscriptions.

Order of precedence

If there is any conflict, the terms are applied in this order: (1) the agreement attached to your accepted AWS Marketplace offer, including any order form or pilot success criteria it references; (2) this page, which is a summary for convenience only and does not add to or change those terms.

Key points in plain language

Your data stays yours. DRAKE OS runs in your AWS account. You own your data, and we do not receive a copy of it.

Our software stays ours. Shackleton & Drake retains all rights in DRAKE OS, including its software, models and documentation. Your subscription gives you the right to use it during the subscription term.

Billing runs through AWS. Subscription fees are billed by AWS Marketplace. AWS infrastructure usage from running DRAKE OS in your account is billed to you separately by AWS.
